Terms of use

These terms apply to your use of the acteurly.ai website and the Acteurly service, provided by Acteur Social Marketing, a Québec business working remotely across North America. By using the service, you accept them. If the two versions differ, the French version prevails.

The service

Acteurly is an AI-powered marketing analyst. It reads the information you give it or authorize, explains what works and recommends actions. The service is in active development: features may be added, changed or removed.

The free diagnostic

The free diagnostic analyzes a business's public content (its website, social media and search results). It is limited to one diagnostic per month (30 days) per browser, and daily capacity is limited. You agree not to get around these limits, including by automated means.

Your account

You provide accurate information, keep access to your email secure and are responsible for activity on your account. Tell us right away about any unauthorized use.

Connected tools

When you connect a tool (Google, Meta, LinkedIn or other), you authorize us to read the data needed for the analysis. If you allow publishing, Acteurly publishes on your behalf only what you approved, text by text; you remain responsible for the content published on your accounts and can remove a post (through Acteurly when the platform allows it, otherwise in that app). You can disconnect a tool at any time. Those services' own terms still apply.

Recommendations and AI

Analyses and recommendations are partly produced by AI and may contain errors. They are provided for information and are not legal, accounting or financial advice. You remain responsible for your decisions, and no result is guaranteed.

Your data and content

You keep ownership of your data and content. You allow us to process them only to provide the service, as described in our privacy policy. We may use de-identified, aggregated statistics to improve the service. We never sell your data.

Our property

The Acteurly software, brand, knowledge base and content belong to us. These terms don't transfer any intellectual property rights to you.

Acceptable use

You agree not to:

  • use the service for illegal purposes or to send unsolicited messages;
  • copy, disassemble or try to extract the code, models or knowledge base;
  • scrape the service or get around its limits and security measures;
  • upload other people's personal information without the right to do so.

Pricing and payment

The Free plan costs nothing and has usage limits (for example, a number of questions to Aly per month); when a limit is reached, the service offers you a paid plan. Invited pilot businesses use Acteurly free for the period stated in their invitation.

Paid plans (Essentiel and Pro) are monthly or yearly subscriptions. The price, in Canadian dollars, and any applicable taxes are shown before you pay. Payment is processed by Stripe; the subscription renews automatically at the start of each period and is charged to the card on file until it is cancelled.

You can change plans or cancel at any time in "Plan and billing" (Stripe's secure portal). Cancellation takes effect at the end of the period already paid: access stays open until then, after which the account moves to the Free plan with no further charge. Unless the law requires otherwise, periods already started aren't refunded. If a payment fails, Stripe retries for a few days; without payment, the account returns to the Free plan. Deleting your account also cancels the subscription.

We'll email you at least 30 days before any price change; the new price applies at the next renewal, and you can cancel before then.

Availability and suspension

We do our best to keep the service available, without guaranteeing it will be uninterrupted. We may suspend an account that doesn't follow these terms.

Limitation of liability

To the extent permitted by law, we are not liable for indirect damages, such as lost profits or data, and our total liability is limited to the amounts you paid us in the last 12 months. Nothing in these terms limits your rights under Québec's Consumer Protection Act, where it applies.

Ending your use

You can close your account at any time. We may end the service or your account with reasonable notice, except in case of a serious breach of these terms.

Changes

We may change these terms. We'll tell you by email or in the app at least 30 days before any significant change.

Governing law and language

These terms are governed by the laws of Québec and the applicable laws of Canada. Any dispute falls under the courts of the judicial district of Montréal. The French version of these terms prevails.
